GENERAL TERMS AND CONDITIONS

PREAMBLE
These General Terms and Conditions (T&C), subject to French law, are intended to govern
the use of the online game MINESWEEPER also called ONLINE MINESWEEPER
(hereinafter "The online game" or "online game")
made available on the internet by NHT-DEV (French Sole Proprietorship).
MINESWEEPER is hosted in France by the provider O2switch - https://www.o2switch.fr/.
The use of the online game according to the modalities referred to below implies your express and unconditional acceptance of the T&C.
The Terms and Conditions are subject to change at any time by MINESWEEPER. The user should therefore regularly refer to the latest version of the T&Cs, which are always available on the website.
ARTICLE 1: GENERAL DESCRIPTION OF THE SERVICE
MINESWEEPER is an online game via a platform as well as related services.
To the extent that the terms "game" or "services" appear in these General Terms and Conditions, they respectively refer to our games and services. Users of MINESWEEPER as well as participants
in games and services are referred to in this document as "users".
ARTICLE 2: ACCEPTANCE OF CONDITIONS
In order to benefit from the features of the online game, you must have an internet connection
and access the MINESWEEPER application site.
ARTICLE 3: PRICES OF SERVICES
The use of MINESWEEPER is completely free, except for connection and internet access fees that may apply
with other providers.
ARTICLE 4: INTELLECTUAL PROPERTY
The online game MINESWEEPER belongs to and remains the sole property of NHT-DEV.
The presentation and each of the elements, including trademarks, logos and domain names,
appearing on the online game MINESWEEPER, are protected by the laws in force on intellectual property.
All intellectual property rights and other exclusive rights relating to any protectable element
assembled and developed during the execution of this contract remain the exclusive property of MINESWEEPER.
If the user wants to use any protected elements, they must obtain permission for publication, use or adaptation of these elements,
without charge to MINESWEEPER, from the holders of intellectual property rights or other exclusive rights that may exist with respect to them.
MINESWEEPER will hold the end user responsible for any third-party claims arising from the unauthorized use by the end user
of any element protected by intellectual property rights or other exclusive rights, including software.
No element such as editorial content or photographs composing the online game may be copied, reproduced, modified, reissued, uploaded,
distorted, transmitted or distributed in any way, in whole or in part, without the prior written authorization of MINESWEEPER.
Only private use copying is authorized for your personal, private and non-commercial use on your personal computer.
ARTICLE 5: LIABILITY
MINESWEEPER's liability for the Services can only be engaged in the event of proven fault and for direct damages only.
In addition, MINESWEEPER's liability cannot be engaged in the event of force majeure.
ARTICLE 6: FORCE MAJEURE
MINESWEEPER cannot be held responsible, or considered to have failed to comply with these conditions,
for any delay or non-performance, when the cause of the delay or non-performance is related to a case of force majeure
as defined by the jurisprudence of French courts and tribunals, including interruption, suspension,
reduction or disturbances of electricity or other or any interruptions of telecommunications networks.
However, the user declares that the suppliers of materials, software and telecommunications infrastructures used in these areas,
do not offer an absolute guarantee of proper functioning of the MINESWEEPER service. As a user of technologies or infrastructures developed and provided by third parties,
MINESWEEPER cannot guarantee that its service will be uninterrupted and without delay, especially during a "bug" or product updates.
In addition, MINESWEEPER reserves the right to make the online game or services temporarily unavailable for maintenance or update procedures,
or for any other reason, for the necessary duration, without prior notice.
ARTICLE 7: DIVISIBILITY, TITLES, TOLERANCE
The nullity of one of the clauses of the contract subscribed to with MINESWEEPER, in particular in application of a law,
a regulation or following a decision of a competent court passed in res judicata
will not entail the nullity of the other clauses of the contract which will retain their full effect and scope.
In this case, the parties shall, as far as possible, replace the annulled provision with a valid provision corresponding to the spirit and object of the contractual conditions.
The titles of the articles of the contractual conditions have the sole purpose of facilitating references and do not have, in themselves,
a contractual value or a particular meaning.
ARTICLE 8: USER OBLIGATIONS
The user undertakes not to bring any action against MINESWEEPER motivated by a fact arising from the non-compliance
with the navigation constraint mentioned above. The user will have verified that the computer configuration
of the internet connection used does not contain any viruses or and that it is in perfect working order.
MINESWEEPER will in no case be responsible for the malfunctioning of the latter.
The user undertakes in the use of the service not to engage in any acts, of any nature whatsoever,
which would be contrary to French law and, where applicable, to the laws of the country from which he is connecting,
which would infringe French public order or the rights of a third party. The user undertakes not to use cheating means, exploits, robot automation software, hacks,
or unauthorized software designed to modify or interfere with the Service. The user undertakes not to attempt to access the service in an unauthorized manner,
not to create accounts for others or for computers, servers or networks connected to the service by means other than the user interface
provided by MINESWEEPER. The user undertakes not to attempt to circumvent or modify, or encourage or
assist another person to circumvent or modify the security of the service.
ARTICLE 9: APPLICABLE LAW AND JURISDICTION
This contract is governed by French law. This applies to both substantive and formal rules, excluding, on the one hand,
conflict rules provided for by French law, and on the other hand, provisions of French law that would be contrary to this Agreement.
